By accessing or using Boarderly ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service. These Terms constitute a legally binding agreement between you and Boarderly.

2. Description of Service

Boarderly is a mobile application that provides estimated wait times at airport checkpoints including immigration, customs, and security. Our data is aggregated from user-submitted reports and publicly available information.

IMPORTANT: All wait time information provided by this Service is for reference purposes only and should not be relied upon as accurate, complete, or current.

3. User Accounts

3.1 Account Creation

To access certain features, you may need to create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

4. User Content and Reports

4.1 Submission of Reports

By submitting wait time reports or other content, you grant Boarderly a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, modify, display, distribute, and create derivative works from such content for any purpose related to operating and improving our Service.

4.2 Content Guidelines

You agree not to submit content that:

  • Is false, misleading, or intentionally inaccurate
  • Violates any applicable laws or regulations
  • Infringes on the rights of others
  • Contains spam, malware, or harmful content
  • Harasses, threatens, or discriminates against others

5. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Scrape, crawl, or collect data from the Service without permission
  • Create multiple accounts for fraudulent purposes
  • Impersonate others or provide false information
  • Use the Service to make critical travel decisions without independent verification

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

BOARDERLY EXPRESSLY DISCLAIMS ANY AND ALL LIABILITY FOR THE ACCURACY, COMPLETENESS, RELIABILITY, TIMELINESS, OR AVAILABILITY OF ANY INFORMATION PROVIDED THROUGH THE SERVICE.

ALL INFORMATION PROVIDED THROUGH THIS SERVICE, INCLUDING BUT NOT LIMITED TO WAIT TIME ESTIMATES, QUEUE PREDICTIONS, AND AIRPORT CHECKPOINT DATA, IS FOR INFORMATIONAL AND REFERENCE PURPOSES ONLY. THIS INFORMATION DOES NOT CONSTITUTE ADVICE, RECOMMENDATION, OR GUARANTEE OF ANY KIND.

Wait time estimates are derived from user-submitted reports and algorithmic predictions. These estimates:

  • May be inaccurate, outdated, or incomplete
  • May not reflect actual current conditions at any airport
  • Should never be the sole basis for travel planning decisions
  • Are subject to change without notice
  • May differ significantly from actual wait times experienced
  • Are based on crowdsourced data that cannot be independently verified
  • May contain errors due to user input mistakes, system errors, or other factors

YOU ACKNOWLEDGE AND AGREE THAT YOU USE THE INFORMATION PROVIDED BY THIS SERVICE ENTIRELY AT YOUR OWN RISK. YOU ARE SOLELY RESPONSIBLE FOR VERIFYING ANY INFORMATION BEFORE MAKING TRAVEL DECISIONS.

7. LIMITATION OF LIABILITY AND EXCLUSION OF DAMAGES

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BOARDERLY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Missed flights or transportation connections
  • Travel delays or disruptions
  • Financial losses, including ticket rebooking costs
  • Loss of business opportunities
  • Emotional distress or inconvenience
  • Any other damages arising from reliance on the Service's data

THIS LIMITATION APPLIES REGARDLESS OF WHETHER SUCH DAMAGES ARISE FROM:

  • Inaccurate, incomplete, or outdated wait time information
  • Service interruptions or unavailability
  • Errors in algorithmic predictions
  • User-submitted data that is false or misleading
  • Any other use of or reliance on the Service

EVEN IF BOARDERLY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND EVEN IF THE REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

IN NO EVENT SHALL BOARDERLY'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID TO BOARDERLY, IF ANY, DURING THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

8. Indemnification

You agree to indemnify, defend, and hold harmless Boarderly and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

9. Intellectual Property

The Service, including its design, features, and content (excluding user-submitted content), is owned by Boarderly and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive.

11. Changes to Terms

We may modify these Terms at any time at our sole discretion. Material changes will be communicated through the app or by email. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved through binding arbitration in Tokyo, Japan, except that either party may seek injunctive relief in any court of competent jurisdiction.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Boarderly regarding the Service and supersede all prior agreements and understandings.
